Virginia allows 1,600 self identified non citizens to vote?

Virginia Is for Non-Citizen Voters

A federal judge orders 1,600 people restored to the state’s voter rolls.

Glenn Youngkin is hopping mad—and with good reason. A federal judge on Friday ordered Virginia to restore the registration of 1,600 people on the voter rolls who were removed on grounds they aren’t U.S. citizens.


“Let’s be clear about what just happened,” Virginia’s Governor said in a statement. “[O]nly eleven days before a Presidential election, a federal judge ordered Virginia to reinstate over 1,500 individual—who self-identified themselves as noncitizens—back onto the voter rolls. Almost all these individuals had previously presented immigration documents confirming their noncitizen status, a fact recently verified by federal authorities.”


The injunction by federal Judge Patricia Giles is the latest development in a suit brought by the Justice Department earlier this month. Justice says Virginia is violating the National Voter Registration Act, which forbids states from “systematically” removing registered voters in the 90-day “quiet period” before an election. Gov. Youngkin and Virginia argue that their effort is individual and not systematic, because the process starts when the individual submits information identifying himself or herself as a noncitizen.


Justice argues that Virginia’s process is flawed and would end up removing voters who are American citizens too. But Mr. Youngkin has a number of failsafes. For one thing, those removed are notified by the state and given 14 days to restore their voter registrations by proving they are citizens. If all else fails, they can still register on Election Day and cast a provisional ballot.


Mr. Youngkin calls the judge’s ruling “stunning” and said Virginia is applying to the Fourth Circuit Court of Appeals for an emergency stay of Judge Giles’s injunction. Virginia will appeal all the way to the Supreme Court if necessary. None of this helps public confidence in ballot integrity.


The Virginia statute in question was signed in 2006 by Democratic Gov. Tim Kaine. Mr. Youngkin notes that in the 18 years since, governors of both parties have used it. So why is Attorney General Merrick Garland making an issue of it now? Readers can guess the Occam’s razor answer.
