WASHINGTON, Dec 10 (Reuters) - A federal appeals court judge's attendance at a rally for U.S. President Donald Trump is drawing scrutiny from critics who say his presence violated judicial ethics rules.
Emil Bove, a former personal lawyer for Trump appointed by the president to the 3rd U.S. Circuit Court of Appeals, was spotted at the event at a Mount Pocono, Pennsylvania casino on Tuesday night. Trump touted his economic record at the campaign-style rally but often veered into partisan attacks on the “radical left,” transgender rights and Somali migrants.
On Wednesday, the private judicial watchdog group Fix the Court filed a misconduct complaint accusing Bove of violating canons that require judges to avoid appearances of impropriety and refrain from political activity.
“Attending a Trump event — and not leaving when it became clear that the speech was, in fact, a partisan rally — violates this canon,” the group wrote, opens new tab.
A representative from Bove’s court office said he had no comment. The complaint, filed with the Judicial Council of the 3rd Circuit, does not automatically trigger a full investigation.
At the event, Bove told, opens new tab a reporter at cable news channel MS NOW that he was “just here as a citizen coming to watch the President speak.”

The U.S. Senate confirmed Bove to the 3rd Circuit bench in July in a 50-49 vote. The court hears cases from Pennsylvania, New Jersey and Delaware.
Senate Democrats who opposed Bove’s nomination said Trump was appointing a loyalist to a key appeals court. Bove had been serving as a senior Justice Department official prior to his confirmation.
More than 900 former DOJ lawyers separately urged the Senate to reject Bove, citing his role in what they called a Trump-era assault on “constitutional principles and institutional guardrails.” Bove denied accusations that he advised the Trump administration to defy court orders. Republicans praised his record as a prosecutor and defense lawyer.
Judicial ethics scholar Charles Geyh of Indiana University’s law school said Bove’s confirmation process highlighted concerns about whether he would serve as a judge with independence and impartiality.
